Gorkana is a Global media intelligence business with over 500 UK based staff. They acquired a number of leading media intelligence software businesses in 2015. Ortolan’s employment law specialists supported the Gorkana HR team to ensure a smooth TUPE transfer and provide advice regarding the appropriate level of staff engagement during this cross border consultation process. Following the transfer, once the new UK group structure was finalised, we supported the experienced HR team in producing the necessary documentation to ensure it was not only legally compliant, but also caused minimum disruption to staff.
We provided real-time advice to the HR team about necessary consultation obligations and drafted and reviewed all of the required documentation to ensure UK legal compliance both in relation to the TUPE transfer and the restructure.
- All necessary TUPE transfer consultation letters were sent to staff thus minimising the risk of any successful unfair dismissal claims or any collective consultation breaches and a risk of a protective award.
- The redundancy and business restructure was completed within Gorkana’s required timeframe and with as little impact to “at risk” staff as possible.
- No Employment Tribunal claims were threatened.
