Can The Planning System Improve Your TV Viewing?
Hertsmere Council is this week deciding whether to introduce Local Development Orders (LDO) to cover Sky Studios Elstree and Panattoni Park in Borehamwood. Sky Studios is a large film and TV studio comprising 12 sound stages, offices, production and workshop spaces, screening rooms and ancillary facilities. Panattoni Park is used for storage and other facilities to support Sky Studios.
What is an LDO?
LDOs authorise specified development within a defined area. An LDO provides certainty and reduces administrative burden because any development within the defined area that meets the LDO terms can proceed without the need for planning permission. There are limits to the use of an LDO. For example, an LDO cannot apply to a listed building.
The permission effectively granted by an LDO can either be unconditional or subject to specified conditions or limitations. An LDO may be put in place for a specified time limit or in perpetuity, although an LDO can be revoked at any time.
Local Planning Authorities must consult on draft LDOs for a minimum of 28 days. For an LDO to come into effect it must be adopted by resolution of the Local Planning Authority and the Secretary of State must be notified.
Sky Studios Elstree LDO
The draft LDO for Sky Studios Elstree explains the aim of the LDO to be to “support the screen sector by allowing future changes to take place on the site without having to apply for formal planning permissions every time new productions and production companies use the site. This will enable an adaptable and dynamic environment for the file and television industry…”.
There are conditions that apply across the proposed LDO area regulating light and noise levels, flood risk, access, duration and use and monitoring. The draft LDO is also split into three zones and additional conditions apply to each zone.
Assuming that the LDOs are adopted, the use of this alternative consenting regime may, tenuously, improve the viewing options available to us all. It might also serve as a good example of the planning regime facilitating rather than obstructing.
