Case Review: R (TTT) v Michaela Community Schools Trust [2024]

This case concerned the lawfulness of a school’s policy prohibiting ritual prayer for all its pupils.  The question the court had to consider was whether it interfered with a Muslim pupil's right to freedom of thought, conscience and religion under Article 9 of the ECHR.

The much-awaited judgment confirmed that it did not and in addition, it did not constitute indirect religious discrimination contrary to section 85 of the Equality Act 2010 and the school's governing body and headteacher had not breached the public sector equality duty (PSED).

In its finding it was decided that the prohibition did not interfere with pupils’ rights, and was in any event justified in the circumstances of the case as it disadvantaged Muslim pupils.
