Cladding Crisis Update

As we noted in January’s update, Secretary of State for Levelling Up Michael Gove indicated to the construction industry that they had two months to agree to a financial contributions scheme to fund the new plan, before the government imposes a solution in law.

On March 7, 2022, by way of a letter in response to the Industry Proposal on Building Safety he was presented on 25 February 2022, Gove welcomed partly the proposals presented but did not consider them to go far enough and repeated his request that the industry must “agree a fully funded plan to fix unsafe buildings by the end of March”. As part of this process, Gove expects developers to make public commitments, noting also that “if an agreement is not reached by the end of March, … [the] government will impose a solution in law and … impose this solution through the Building Safety Bill”.

I’ve personally worked with Ortolan Legal’s managing director on a number of transactions. Their legal advice doesn’t come wrapped in multiple caveats; it takes account of the commercial realities businesses face. Technically, they are really capable and they’re also highly personable people to work with. They represent real value for money.
