Electronically signed deeds are legal

The Lord Chancellor and Secretary of State for Justice, Robert Buckland, has confirmed that the use of electronically signed deeds is legal, stating that electronic signatures “are permissible and can be used in confidence in commercial and consumer documents”.

The written statement follows the publication of the Law Commission’s report on Electronic Execution of Documents. In that report, the Commission found that in ‘most cases’, “electronic signatures are capable in law of executing a document (including a deed) provided that the person signing intends to do so and that any further required formalities, such as a witness, are satisfied”.
