New version of How to Rent guide

The government has published a new version of How to Rent: the checklist for renting in England (How to Rent guide).

The new version of the How to Rent guide includes extensive amendments, which provides tenants with more comprehensive information for houses in multiple occupation (HMO) licensing requirements, tenant fees, tenancy deposits and rent repayment orders.  The guide also refers to the requirement for mandatory electrical testing in the Electrical Safety Standards in the Private Rented Sector.

As has been the case now for some time a landlord under an assured shorthold tenancy (AST) will be prevented from serving a notice seeking possession under section 21 of the Housing Act, unless it has complied with certain legal requirements and provided the tenant with prescribed information. The prescribed information is a copy of the current version of the How to Rent guide. Landlords granting ASTs on or after 10 December 2020 should therefore ensure that they supply the current version of the How to Rent guide to the tenant.

Interestingly the new version of the How to Rent guide refers to the government's intention to abolish "no fault" evictions under section 21 of the HA 1988. This indicates that such a reform remains on the government's agenda, despite draft legislation not being produced since this was first mentioned in April 2019.
