Unlawful Trading In Personal Data - £1,000 fines imposed
A former employee of a car rental company who sold almost 28,000 customers’ records has been fined £1,000.
Ms Nagra was an administrative assistant at Enterprise Rent-A-Car and was responsible for processing customers details sent by an insurance company. The details typically related to people who had been in road traffic collisions and included details of the policy holder as well as details of their insurance claim.
Ms Nagra, who worked from home, had been photographing the details while they were on her computer screen and sold them to a Mr Ihediaw for £5,000. It is understood the details were passed to accident claim companies to make nuisance calls. Mr Ihediaw was also fined £1,000.
The Information Commissioner’s Office was disappointed with the leniency of the sentence stating that “with so much concern about the security of data, it is more important than ever that the courts have at their disposal more effective deterrent penalties than just fines. People who break the criminal law by trading in other people’s personal information need to know that they will be severely punished and could even go to prison. We’ve been pushing for this for some time. Parliament voted for it to happen more than seven years ago but it remains on a Westminster backburner. It is high time that changed.”
