Unpaid interns and national minimum wage

Not yet a court case but a timely reminder to employers to ensure that they are complying with national minimum wage laws.

Graduate Fog, a campaign for better treatment of young workers, has criticised Cefinn, Samantha Cameron’s clothing label which this month been seeking unpaid interns to ‘manage samples’ and ‘carry out market research’ for a three-month stint.

Speaking to The Guardian, De Grunwald of Graduate Fog said: “This advert clearly describes a skilled job involving real work – which means that Cefinn should offer a proper, legal wage”.

Although some unpaid internships are allowed, such as job shadowing, those under 16 and doing a short period of work experience or carrying out less than a year’s work as part of a higher education course, anyone carrying out tasks that defines them as a worker requires paying the national minimum wage.

Employers should use this reminder to ensure they are not falling into the same trap.
